BLE engineer gets $125,000 in back pay

Largest award in GTW history

BLE Brother J.E. Greyzck, a member of Division 850 (Flat Rock, Mich.), was awarded $124,285.20 in back pay after a two-and-a-half year battle with the management of the Grand Trunk Western Railroad.

It was ruled by the First Division of the National Railroad Adjustment Board that the carrier abused its managerial powers when it pulled Greyzck out of service on Dec. 30, 1996, and subsequently dismissed him from service on Jan. 29, 1997, for allegedly violating the Carriers Rule G.

First Division Award No. 24988 awarded Brother Greyzck all back pay lost during his improper dismissal and reinstated him with a clean record.

In his battle to be reinstated, Brother Greyzck was assisted by Grand Trunk Western General Chairman John Karakian and the International Division's Arbitration Department in Cleveland.

"From the onset of this case, it was painfully evident to the BLE that the Carrier's case against Brother Greyzck was not supported by a single shread of credible evidence to support its allegations," Karakian said. "Accordingly, we did our homework and immediately secured documented evidence that Brother Greyczk was not subject to DOT Probable Cause Testing."

When the evidence was presented to the First Division, the Board sustained the claim as submitted by the BLE. In the decision, Referee Richter stated:

"To dismiss an employee with such a length of service without proof of guilt is a miscarriage of industrial justice."

The Referee then ordered the carrier to restore Brother Greyczk to service, to clear his service record, to restore any and all benefits and entitlements and to pay his lost wages.

According to GTW Labor Relations, this is the largest monetary settlement ever rendered through an award involving GTW and one of its engineers.

"It was especially gratifying to win Brother Greyczk's case," said Karakian. "We are professionals and we will accept nothing less than professional treatment in every phase of our employment relationship with CN/GTW." ·

Plan ahead for the year 2000!
